1. Acceptance of Terms
Welcome to Chefolio (“Chefolio LLC,” “Chefolio,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, mobile app, and services (the “Service”)—whether you are a Client booking a Chef or a professional Chef offering culinary services.
By creating an account, booking services, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use Chefolio.
2. Description of Service
Chefolio connects individuals and groups (“Clients”) with professional chefs (“Chefs”) for in-home dining, events, meal prep, and culinary experiences. Our platform provides:
- Chef discovery, profiles, reviews, and ratings
- Menu planning, customization, and invoicing
- Secure payment processing and transactional support
- Direct messaging and booking management
- Post-event feedback and support
3. User Accounts & Roles
3.1 Account Creation
To use Chefolio, you must register and provide accurate, up-to-date information. You are responsible for maintaining the confidentiality of your credentials.
3.2 Roles & Eligibility
- Clients: Individuals or organizations booking Chefs. Must be at least 18 years old.
- Chefs: Professional cooks offering services. Must hold any required food-safety certifications, licenses, and insurance.
3.3 Account Security
You are responsible for all activity under your account. Notify us immediately of any unauthorized use.
4. Chef Obligations
Chefs agree to:
- Provide accurate profiles, menus, and availability
- Maintain food-safety standards, licenses, and insurance
- Communicate clearly and honor confirmed bookings
- Arrive prepared with ingredients, equipment, and attire
- Comply with all applicable health and safety regulations
5. Client Responsibilities
- Provide accurate event details, dietary needs, and allergies
- Ensure a safe, clean workspace and necessary kitchen access
- Make timely payments as outlined in the booking
- Treat Chefs with professionalism and respect
- Leave honest feedback after each service
6. Booking & Payment
6.1 Booking Confirmation
A booking is confirmed when both Client and Chef accept the terms and any required deposit is processed. All bookings are subject to Chef availability.
6.2 Fees & Processing
Chefolio facilitates payments and charges a service fee on each transaction. Deposits, final payments, and refunds are processed according to the booking agreement.
6.3 Cancellation & Refunds
- More than 48 hours: Full refund minus processing fees
- 24–48 hours: 50% refund
- Less than 24 hours: No refund unless the Chef agrees
7. Prohibited Conduct
You may not:
- Violate any laws or third-party rights
- Impersonate others or post false information
- Harass, threaten, or discriminate against any user
- Circumvent our fees or payment systems
- Use bots or automated means to access the Service
- Interfere with platform security or integrity
8. Intellectual Property
All content and technology powering Chefolio are owned by Chefolio Inc. Users retain ownership of content they upload but grant us a license to display and distribute it in connection with the Service.
9. Disclaimers & Limitations
9.1 Service Disclaimer
Chefolio is a booking intermediary and is not responsible for the quality or safety of any services provided by Chefs.
9.2 Limitation of Liability
To the fullest extent permitted by law, Chefolio is not liable for indirect, incidental, special, or consequential damages arising from your use of the Service.
10. Indemnification
You agree to indemnify and hold Chefolio and its affiliates harmless from any claim, loss, liability, or expense arising from your breach of these Terms or your use of the Service.
11. Termination
We may suspend or terminate your account at any time for violations of these Terms or for any conduct we deem harmful. You may also close your account through your settings.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of Texas. Any disputes will be resolved by binding arbitration in Frisco, Texas, under the rules of the American Arbitration Association.
13. Changes to Terms
We may update these Terms. If changes are material, we will notify you at least 30 days before they take effect by email or in-app notice.
